Don’t see how this is a legitimate collective bargaining tactic at all. Do you ever see the Teamsters, Mine Workers, Steelworkers, etc. doing this when they have very legitimate concerns about working conditions, hours, etc.? The NBAPA only has 30 “locals” with what, 15 or fewer members each? Hard to see the justification for Federal Mediation at all, except that people in the Department of Labor (not to mention elsewhere in government, like the Fan-in-Chief) are interested in pro basketball.

How can Billy Hunter and David Stern sit down and discuss this now? With this disclaimer being brought in, Hunter should no longer have anything to do with these discussions, yes? How can the union say they no longer wish to represent the players, then the head of the union continues to negotiate?

Didn’t the NFL case revolve around the clause in old NFL CBA which prevented desertification unless it was within a certain timeline? If that the case, it would matter for the NBA, would it?
